Please read these Terms of Service (“Terms”) carefully before using afmcgroup.com (the “Site”) operated by Accountable Financial Management Corp, doing business as AFMC NY (“AFMC NY,” “we,” “us,” or “our”), a licensed New York State real estate brokerage (NYS License #109913614). By accessing or using the Site, you (“User” or “you”) agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site.

1. Agreement to Terms

These Terms constitute a legally binding agreement between you and AFMC NY. Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Site. By accessing the Site, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the effective date at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

2. Services Described

AFMC NY (Accountable Financial Management Corporation) operates this Site as a licensed New York State real estate brokerage under NYS Department of State License #109913614. Our principal broker is Seymour Williams. This Site is not a mortgage lender, mortgage broker, or mortgage loan originator. Mortgage services are offered by our separately licensed sister brand, AFMC Money, at afmcmoney.biz — a NYDFS/NMLS-regulated mortgage services company with its own terms and disclosures. The Site provides information about:

• Residential properties for sale, rent, and lease in New York City
• Commercial properties available for lease
• Buyer and seller representation services
• NYC real estate market data and insights
• General information about buying, selling, renting, and leasing property in New York

3. Not Legal, Financial, or Investment Advice

AFMC NY makes no representations or warranties regarding the accuracy, completeness, or timeliness of listing data. Listing information is provided “as is” and is subject to change without notice.

All square footage, room counts, lot dimensions, taxes, assessments, and other property details are approximate and should be independently verified by you and your representatives prior to entering into any transaction. AFMC NY is not liable for errors, omissions, or discrepancies in listing information.

The MLS and IDX data on this Site are protected by copyright. Unauthorized reproduction, redistribution, or commercial use of MLS data is strictly prohibited.

5. Mortgage Services — Handled by Sister Brand

This Site is operated by a New York State real estate brokerage and does not originate mortgages, quote rates, or take loan applications. Any reference to financing on this Site is a referral to our separately licensed sister brand, AFMC Money, at afmcmoney.biz. AFMC Money is a NYDFS/NMLS-regulated mortgage services company and maintains its own terms, disclosures, and licensing information. Any rate, product, or pre-qualification communication occurs on that separately licensed website.

6. Intellectual Property

The Site and its original content, features, and functionality are and shall remain the exclusive property of AFMC NY. The AFMC NY name, logo, wordmark, and related marks are proprietary to Accountable Financial Management Corp. Nothing in these Terms grants you any right, title, or interest in AFMC NY intellectual property.

You may not reproduce, distribute, modify, transmit, display, publish, sell, license, or create derivative works from any content on the Site without our prior written consent, except for your personal, non-commercial use.

7. User Conduct

By using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation
• Submit false, misleading, or fraudulent information through any form or inquiry
• Attempt to gain unauthorized access to any portion of the Site or its systems
• Use automated scripts, bots, scrapers, or crawlers to collect data from the Site without our written consent

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, AND INFORMATION PROVIDED THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AFMC NY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

AFMC NY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AFMC NY DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SITE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AFMC NY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR THE SERVICES, EVEN IF AFMC NY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL AFMC NY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO AFMC NY IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless AFMC NY and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys' fees) arising from or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the Site caused damage to a third party.

11. Fair Housing Statement

AFMC NY is committed to compliance with all applicable fair housing laws. We do not discriminate in the sale, rental, or financing of housing on the basis of race, color, national origin, religion, sex, familial status, disability, age, sexual orientation, gender identity or expression, marital status, lawful occupation, immigration or citizenship status, source of income, military status, or any other characteristic protected by federal, state, or local law.

Any user of this Site who engages in discriminatory conduct — including steering, blockbusting, or any other discriminatory housing practice — will have their access to AFMC NY services immediately terminated. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. We strongly advise you to read the terms and conditions and privacy policies of any third-party sites you visit.

14. Termination

We reserve the right to terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Kings County, New York. You consent to personal jurisdiction in those courts and waive any objection to the laying of venue in Kings County.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by AFMC NY on the Site, constitute the entire agreement between you and AFMC NY concerning the Site and supersede all prior and contemporaneous agreements, representations, and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
